So you were suspended by Amazon for Inauthentic or some form of your products are not Authentic.
Amazon then in turn a month later decided to create a Disposal Order to trash your whole inventory. Since you are suspended they refuse to cancel the Disposal Order and do anything.
Amazon’s Argument 1:
Amazon’s Lawyer will have the argument that you received an email a couples weeks before that if you did not create a Removal Order your inventory would be Auto Disposed.
Your argument 1:
The first thing you should show to the Arbitrator is that you tried to cancel the Disposal Order. While yes Amazon warned you; There are no reasons why Amazon would not allow you to cancel the Disposal Order and let you remove your inventory.
You can show the Arbitrator that you pay storage fees to Amazon.
Help the Arbitrator understand that because you pay fees for Amazon to store your items you should have an expectation to get your items back.
Possibly show your support tickets where Amazon told you that only seller performance could cancel the disposal order.
Show the stupidity of the fact to the Arbitrator
Amazon’s Argument 2:
Amazon’s Lawyer will have the argument that your inventory was counterfeit or inauthentic and that in this case Items are to be Destroyed.
Your argument 2:
In this case ask for Amazon to show or prove that every item was Counterfeit.
Ask Amazon to prove that every item was Destroyed vs Disposed and sold to a liquidator. If Amazon is stating that it is Inauthentic then why did they sale them to a liquidator?
Also explain that you tried (Argument 1) to create a Removal Order to prove that the items are authentic but Amazon robbed you of the chance to prove your case.
General Arguments:
Ask Amazon at the hearing to provide proof within their system.
One way to prove your case to the Arbitrator is to show him that Amazon is not reasonable. This can be achieved by asking questions to Amazon that they will refuse to answer.
Ask for printed proof such as what Amazon sees in their system, …. Amazon would rather loose than show the world their internal systems and how they work.
